below are the terms and condition of use for en mer, co. and are legally binding. please read this policy carefully as it is assumed you have read and agreed to these terms prior to purchase, use or operation of this website and products. by doing so, you agree to be bound by these terms. if you do not agree, you are not permitted to use or access this site, its services or products.

the words “we”, “me”, “us” or “our” or similar interchangeable pronouns hereby refer to en mer, co. in addition, the words “you", “your” or “the buyer” refer to the buyer or consenting individual or group. the phrase “terms of service” “terms of use” “terms and conditions” and “terms” are all interchangeable.

all images and logos are property of en mer, co. and cannot be used or repurposed without our consent. they also cannot be modified. you agree not to steal any of our property either cyber or physical.

social sharing & reviews

we would be more than happy to see you post about your new digs on your social platforms and share with your friends. when doing so, please respect the nature of the brand and do not post anything that is offensive, inappropriate, misleading or alters the design of the product or brand.

we love to see honesty when people post reviews. by posting a review you agree that it is honest and true and does not have any falsified information. you also agree that by posting a review you have either purchased or used the item you are reviewing. we reserve the right to take action against any reviews that found to be inaccurate or false.

any reviews (either in text or shared via social media such as an instagram story) posted can be redistributed, reposted, or repurposed in any way that we see fit. we will never alter a review except when expressly showing alterations such as by use of grammatical text when needed to shorten or further explain.

termination & refusal of services

we reserve the right to refuse services to anyone who we see fit. we also reserve the right to terminate the account or purchases of anyone when deemed necessary and with cause.

we reserve the right to refuse a return of product. we also reserve the right to refuse a refund if we deem necessary based on our terms or policies.

accuracy

en mer, co. takes every necessary precaution to ensure our product descriptions and website are accurate and honest. however, all claims on this website and products are approximate and should not be a responsible source in full. examples include ounces and grams of products and burn times. we do our best to ensure these are accurate but actual weights and times may vary.

all our products are hand made and hand poured and will naturally show unique variations. these are not product defects and will not affect the value or use of them. you agree that by purchasing you may be receiving a product that looks slightly different from the one imaged but is just as valuable.

our inventory is constantly fluctuating and can change at any given time. while we hate to see it, it is possible that something you purchase may be out of stock once we begin to fulfill the order. in this case, you will receive an email notification (if you have provided your email) noting that your order has been cancelled and you will be refunded. we do not make promises that all inventory or items posted on the website are available at the exact time of purchase or when the order is being fulfilled.

warranties and limitation of liability

en mer, co. candles and all its products present many dangers even when being used effectively including fire hazard, safety to children, pets and pregnant women, and more. by purchasing or receiving any of our services or products, you are assuming ALL responsibility and agree not to hold en mer, co. liable for any dangers that may occur either directly or indirectly from one of our products, services, or website. we take the utmost care to ensure our platform and products are safe but CANDLES & MELTS ARE DANGEROUS.

all en mer, co. products are sold as is and en mer, co. cannot be held responsible before, during or after purchase for any danger, damages, or difficulties that may occur as a result of our products, services or website.

if you are pregnant or nursing, you should consult your doctor before use of any of our products. our products are not intended to be used by minors. our products should be closely monitored at all times, especially around children and pets. our products are hot when lit or while cooling. our jars can and will become hot when lit or cooling and should always be used on heat safe surfaces. our products should never be used for more than 4 hour intervals. our products should be used in areas that are free from drafts, interruptions, fire hazards and more. our products are made using soy wax and candle oil but can contain air pollutants or chemical hazards that can be harmful to the air and to you. our products can be dangerous even while not lit in the case of a fire or similar act. this list of warnings is not all encompassing and candle safety should be taken seriously and accounted for including & beyond this list.

en mer, co. is dedicated to creating products that are meant to be enjoyed and can be enjoyed without worry. however, we are not perfect and neither are our products and services. mistakes are bound to occur on our side or on yours and both are offered without warranty either implied or expressed. if mistakes occur on our end, we reserve the right not to correct them or be held responsible for them. en mer, co. will not be liable to you or anyone who comes in contact with our products, services or website through you as a result of damaging circumstances.

in short, you agree not to sue us or pursue legal action against us as a result of anything negative that occurs to you or those around you (including animals, children, possessions and more) from using our website, products, or services.

indemnification

you agree to defend and indemnify en mer, co. against any legal claims that arise as a result of your behavior, words or actions (either properly or improperly used), either implied or express. you will defend us and hold us harmless from legal claims and attorney’s fees in these circumstances.
